General Conditions of Use

1. Purpose, scope and acceptance of services: 

“Plan SaludAndo” is a program (hereinafter, the Plan) of voluntary affiliation, which makes available to patients and caregivers of legal age, a portfolio of services, benefits and educational content related to participating Sandoz products, with the aim of promoting the accessibility and continuity of the treatment prescribed by the treating physician.

For users, the Plan provides support by including free services that include, but are not limited to: (i) Accumulating amounts in each purchase of participating medications during the validity of the Plan; (ii) Apply and receive discounts from the second purchase, when they already have accumulated amounts to apply in discount mode or through a promotional coupon; (iii) Have access to additional free treatments for the purchase of Sandoz medications that participate in this plan and/or according to the discount mechanics that SANDOZ provides for each brand, product or presentation during a certain period, which will be communicated in a timely manner; and (iv) Have access to content, materials and activities related to your health and well-being.

The purpose of these General Conditions of Use is to regulate the terms and conditions of the Plan, which includes the option of access to the website www.plansaludando.com, in addition to the download and use of the mobile application of that plan, which together will be denominated as: “Plan SaludAndo¨. These digital tools together will be called the “Platform”, and the services provided in them, for patients and caregivers (hereinafter the “users”), are provided by Sandoz Pharmaceuticals Panamá S.A. with address at Costa del Este, Calle Paseo del Mar, No., Lot H 55, Condominio P.H. MMG Tower, Panama, Panama (hereinafter “Sandoz”).

The mobile application can be downloaded from any telephone device of the users’ choice and its download will be free. The mobile application is not essential to use the Plan services. However, having it will allow the user to monitor their account in real time without having to go to the pharmacy to request information about the Plan’s benefits.

The Platform is managed and operated by the company Lealto Costa Rica S.A., as data manager or processor authorized by Sandoz.

The Platform includes the following free services (i) information about the Plan; (ii) registration or subscription to the Plan; (iii) display of the subscriber’s profile for real-time information on their accrual and receipt of notifications; and (iv) content module.

The operation of the Platform and the mobile application will be carried out in Costa Rica, Trinidad and Tobago, Jamaica, Panama and Dominican Republic (hereinafter the “Territory”).

Access and use of the Platform is subject to the following terms and conditions and all applicable laws where applicable.

By accessing or using the Platform you also approve that you have read, understood, and agreed to be bound by these General Conditions of Use without any limitation or condition and acknowledge that any other agreement on the use of this between you and SANDOZ is superseded and void.

You may also voluntarily withdraw from the Platform at any time, which you may do directly in the mobile application or by following section 8 of these terms and conditions.

SANDOZ may at any time suspend, temporarily or permanently, the services for those users who it is proven have not fully complied with these General Conditions of Use, when when registering they provide false or inaccurate information, and in any other case of fraud at the discretion of the owner of the Platform.

Once users have registered through the mobile application or on the website in the web server section of the Platform where the pharmacy will register them, they will be able to access the following free services that include, but are not limited to: (i ) Accumulate amounts in each purchase of participating medications during the term of the Plan; (ii) Apply and receive discounts from the second purchase, when they already have accumulated amounts to apply in discount mode or through a promotional coupon; (iii) Have access to additional free treatments for the purchase of Sandoz medications that participate in this plan and/or according to the discount mechanics that SANDOZ provides for each brand, product or presentation during a certain period, which will be communicated in a timely manner; and (iv) Have access to content, materials and activities related to your health and well-being.

2. About the mechanics of the SaludAndo Plan

When you make a purchase of at least one of the products participating in the Plan, at a participating pharmacy, you will be able to:

• Subscribe to the Plan if you have not already done so.
• Check the account status of your Plan (accumulated amount) or view it in the Plan SaludAndo application.
• Accumulate at the time of purchase an amount in local currency in your Plan user account during the term of the Plan, in accordance with the list of participating products and their accumulation amounts published on www.plansaludando.com . This listing may vary at the discretion of Sandoz. The pharmacy must register this accumulation transaction on the Platform. It is the subscriber’s obligation to request and verify that their accumulation has been registered. The accumulated amounts are valid for 12 months from their registration and upon expiration of that period they will be automatically deleted from each user’s account on the Platform.
• Use partially or totally the accumulated amount available at the time of each purchase, as a discount applied only to some of the products participating in the Plan. The discount will be applied by predetermined ranges in local currency on the Platform. If the user has accumulated an amount greater than the price to be paid for the medication, they may select the discount amount option closest to the final price of the medication. The discount can never be equal to or greater than the sale price of the product and applies only to products listed as participants on www.plansaludando.com.
• The Platform will take the accumulated amount chosen to apply the discount and will automatically debit it from the subscriber user’s account. The pharmacy must register this discount transaction on the Plan platform. It is the user’s obligation to request and verify that their discount has been registered in their user account and is evidenced on their purchase invoice as a final consumer.
• Redeem digital, physical coupons or codes for products as implemented in a special, temporary, or permanent mechanism within the Plan.
• Participate in other limited time promotions defined for certain Sandoz products.

3. About the content module.

The Platform will make available to users a module with educational content to raise awareness about health and well-being habits.

The download of this information or material is at the discretion and will of the user. Sandoz will not incur any payment for the printing, production, delivery or distribution of this physical content. The rights to use this material are limited to its use on the Platform.

4.  Medical information/conditions

The information provided by SANDOZ through the Platform is not intended to provide complete medical information. IF YOU HAVE ANY SPECIAL MEDICAL CONDITION, VISIT YOUR DOCTOR OR HEALTHCARE PROFESSIONAL.   WE DO NOT PROVIDE MEDICAL DIAGNOSIS OR SPECIFIC TREATMENT ADVICE FOR EVERY PATIENT. You should always obtain full medical information with prescription about your condition, medication or medical devices (including its beneficial medical uses and possible adverse events) when discussing the appropriate use of any medication(s) or medical devices directly with your treating physician or, in his absence, another medical adviser.   Patients, physicians and other healthcare professionals should check with local medical resources and the regulatory authorities the appropriate information for your country.  In addition, current regulations in many countries limit (or even prohibit in some cases) the ability of SANDOZ to provide information and/or respond directly to patients’ questions regarding its prescription products.

5. Use of information

You are free to use the Platform, but some options may be limited to accessing, downloading, or using information on this site, including text, images, audio, and video (the “Information”) for personal, non-commercial use. You may not distribute, modify, transmit, reuse, forward, or use the information for commercial purposes, without the written permission of SANDOZ. You must retain and reproduce any and all copyright or other proprietary rights notices contained in the downloaded Information.  You should assume that everything you see or read on this site is copyrighted unless otherwise indicated and may not be used except as provided in these General Conditions of Use. Except as permitted in this section, SANDOZ does not warrant or represent that your use of materials displayed on the website will not infringe the rights of third parties not belonging to or affiliated with SANDOZ.  Except for the limited authorization mentioned above, no license or right to the information, or any copyright of SANDOZ or any other party is granted or conferred to you.

6. Trademarks/Intellectual Property Rights 

You should assume that all product or brand names appearing on this site, whether they appear in large type, italics or with the trademark symbol, are registered trademarks. This site may also contain or refer to proprietary information, technologies, products, processes, or other property rights of SANDOZ and/or other parties involved. No license or right to such trademarks, trade secrets, technologies, products, processes, and other proprietary rights of SANDOZ and/or other parties is granted to or conferred on you.  All names appearing on this site are trademarks owned by or licensed to SANDOZ and/or other parties involved.

7. Exclusion of warranties

Although SANDOZ uses reasonable efforts to ensure that the information is accurate and updated, the information may contain inaccuracies or typographical errors. SANDOZ reserves the right to make changes, corrections and/or improvements to the information, and to the products and services described in said information, at any time and without prior notice.  SANDOZ makes no warranty or representation as to the accuracy of any of the Information contained on the Platform. SANDOZ assumes no responsibility for any errors or omissions in the content of the Platform. ALL INFORMATION IS PROVIDED “AS IS”. SANDOZ MAKES NO WARRANTIES ABOUT THE COMPLETENESS OR ACCURACY OF THE INFORMATION ON THIS SITE OR ITS POSSIBLE USES. THEREFORE, THE INFORMATION SHOULD BE CAREFULLY EVALUATED BY VISITORS TO THE SITE.  NEITHER SANDOZ, NOR ANY OTHER PARTY INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THIS SITE SHALL BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT OR PUNITIVE DAMAGES ARISING OUT OF ACCESS, USE OF OR INABILITY TO USE THIS SITE, OR ANY ERRORS OR OMISSIONS IN THE CONTENT OF THE PLATFORM.   Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to your case.  SANDOZ assumes no responsibility, and shall not be liable for, any damages or viruses that may infect your computer equipment or other property because of your access to or use of the information.

SANDOZ reserves the right to discontinue this Platform at any time without notice and without liability.

8. The information you provide to us

Except for the information protected by our Privacy Policy: www.cac.sandoz.com/aviso-de-privacidad, any communication or material that you transmit through the Platform, including data, questions, comments, suggestions or similar information, is and will be treated as non-confidential and non-copyrighted. Anything you transmit or post becomes the property of SANDOZ or its affiliates and may be used for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, and posting.   Furthermore, SANDOZ is free to use, without compensation, any ideas, concepts, know-how, or techniques contained in any communication you send to the Platform for any purpose, including, but not limited to, development, manufacturing, and commercialization of products/services using such information.

9. Worldwide Products 

This site may contain information about worldwide products and services, not all of which are available in every location. A reference to a product or service on this site does not imply that such product or service is or will be available in your location. The products mentioned in this Platform may be subject to different regulatory requirements depending on the country of use.   Consequently, visitors may be notified that certain sections of this site are intended only for certain groups of users or only for the public in certain countries. Nothing on this Platform should be construed as a promotion or advertisement of any product or for the use of any product that is not authorized by the laws and regulations of your country of residence.

10. Links to other sites

SANDOZ is not responsible for the links to others from this Platform, and, in particular, we are not responsible for the accuracy or legality of their content.  No responsibility is assumed for a breach or omission in the privacy policies of third parties.

11.  Material sent to this site

Although SANDOZ may from time to time monitor or review discussions, chats, postings, broadcasts, bulletin boards and similar information on the Platform, SANDOZ is under no obligation to do so and assumes no liability for the content of such items or for any errors, defamation, injury, slander, omission, falsehood, promotional materials, obscenity, pornography, profanity, danger of disclosure of privacy or inaccuracy contained in any information within such places on the Platform.   You are prohibited from posting or transmitting any unlawful, promotional, threatening, defamatory, obscene, scandalous, pornographic, or profane material, or any material that could constitute or encourage a conduct that would be considered a criminal offense, giving rise to civil liability, or violating any law.  SANDOZ will fully cooperate with any legal authority or court order requesting SANDOZ to disclose the identity of any person posting such information or materials.

12.  Consequences

If we become aware that you have breached any of the terms and conditions contained in this Legal Statement, we may immediately take corrective measures, including preventing the user from using the services offered by SANDOZ and removing any information, data and content posted on the Platform by the user, at any time and without prior notice.  If we have been harmed by your breach, we may, at our discretion, seek compensation from you for damages.

13. Reviews

SANDOZ may at any time revise these General Conditions of Use by updating this publication.  You are bound by any such revisions; therefore, you should periodically visit the Platform to review the current terms and conditions to which you are bound.
